Do It Yourself Divorce Texas - How to Conduct a DIY Divorce in the State of Texas E-mail

"There are certain rules you must follow."
You can conduct your own divorce in the state of Texas. You can do so without engaging a lawyer. All the information you need, the forms you must complete and the instructions are free and online. They can be read and downloaded from this very web site.

There are certain rules you must follow. Remember thousands of Texans have successfully conducted their own divorce. You are about to do what many have done already. This process is not new.

There are some important dates you need to know about.
  1. One of the spouses has to have resided in Texas for at least six months before you can file for divorce.
  2. One of the spouses must have lived in the county in which the application for divorce is made for at least 90 days.
  3. Once you apply, the court will not grant the divorce for at least 60 days.

There are only two grounds for divorce in Texas.
  1. The marriage has irretrievably broken down and there is no reasonable expectation that it can be restored.
  2. The couple has lived separately and apart without cohabitation for at least three years.

So if your marriage situation successfully meets the criteria set out above, you are able to conduct your own divorce. Mind you, there is nothing to stop you researching the divorce procedure immediately while waiting for the time limit to tick over.

Now first things first. Follow the instructions set out on this web page to the letter of the law; literally to the letter of the law. For instance you need to use certain words where requested and you need to spell these words correctly and in some cases paying attention to capital letters.

For example the words PETITION FOR DIVORCE, which is what you will be making, must be as shown, all in capital letters. If you are making the application, you are the Petitioner and again that word must have a capital P.

Now every divorce is unique and you need to concentrate only on those divorce forms which apply to you. Do you have a child or children who are dependants? If YES then you will read and download the form Standard possession order regarding children. Obviously if you have no dependant kids than this form is irrelevant in your divorce situation.

Apart from the actual forms themselves, there are even separate forms which list the instructions, provide explanations of the legal words and an overview of divorce within the state of Texas. Everything is provided to guide you through the process.

There are administrative costs charged by the court for your divorce application but these are not expensive and if you and your spouse can agree on the split of any joint assets, then the inexpensive court costs should be the only financial outlay you will need to make.

The vast majority of divorce cases do not need a lawyer and you can conduct a do it yourself divorce by following the guidelines and rules as explained above.
