If your spouse drew from his or her personal account in purchasing the car, then it is unlikely that you will get your fair share of the money he or she got from selling the car. If the money used to purchase the car during your marriage came from your joint account, then the money your spouse earned from selling the car will be divided, even your spouse has spent it or not.
