If a couple merge their separation agreement they create certain conditions. The merged separation agreement is then regarded as a single document and neither party can take legal action against the other with relation to any part of the agreement.
    
It all depends on what you are trying to achieve when filing for divorce. Clearly reaching agreement with your spouse should ensure a speedy and cheaper divorce. But if matters arising from the merged agreement are challenged, the rights of each spouse to sue will have been removed.
