The amount of alimony you will have to provide to or receive from your partner depends on how the court or lawyer has computed different factors. Below are the general guidelines that are used to compare both spouses in determining the amount of spousal support to be provided:

  • Nature of assets acquired by both spouses after divorce and their potential value as years elapse
  • Financial situations of both spouses once their divorce takes effect
  • One’s desirability for employment given his or her professional skills and expertise
  • The tax consequence that both spouses will incur in the providing and receiving of alimony
  • The capacity of either spouse to provide alimony and at the same time take care of their needs

However, do not be surprised if your lawyer comes up with a different amount for your alimony compared to the lawyer of your spouse. The reason for this is that the lawyer of your spouse is underestimating your value and thus has arrived at a lower figure compared to what you and your lawyer have in your hands. What happens here is that both lawyer will negotiate and arrive at a figure in between the figures administered by both lawyers.
