Just because a couple agrees on the wording of their divorce agreement doesn’t mean the court will approve such an agreement. In fact any agreement on child custody will be heavily scrutinized by the court. The overriding  factor is what is in ‘the best interests of he child’.
    
Just because the parents have set out what they believe is the right thing for their child or children doesn’t mean the court will agree. In any case the parents can expect a series of questions from the judge. He or she will want to be satisfied that the child will be receiving the best possible care once the divorce has been granted.
