Yes and no. Yes, you can deduct legal fees that are paid in the pursuit of income such as alimony that is taxable. No, you cannot deduct legal fees for personal business such as child support, custody, or a divorce. If the legal advice or fees are associated with pursuing legally reportable and taxable income then ensure it is billed separately from any non-deductible expenses so it is easiest to deduct the legal fees that are allowable.
