No they are not necessary but you would be wise to have one. Why? Well no judge is going to approve an application for divorce without first investigating every relevant aspect of the marriage.
    
This can take time and time costs money. Even if you do have a separation agreement that does not guarantee the judge will simply rubber stamp it. In fact he or she won’t but an agreement shows the court that you are serious about obtaining your divorce and you have spent time working out what is to be done with such issues as child custody, child support, alimony, division of property, responsibility for debts and any other matters arising from the marriage.

If you want to help yourselves, produce a separation agreement.
