Before the divorce is filed, one of the spouses must have been a resident of Vermont for at
least 6 months. Additionally, either spouse must have been a resident for one year before the
divorce is made final. There is a 6 month waiting period after the defendant has been served
with the divorce papers before a hearing will be held. The divorce may be filed for in any
county where either or both of the spouses reside. [Vermont Statutes Annotated; Title 15,
Sections 592 and 593; Vermont Rules for Family Proceedings, Rule 4].
The only no-fault ground for divorce in Vermont is: Living separate and apart without
cohabitation for 6 consecutive months and the resumption of marital relations is not
reasonably probable. [Vermont Statutes Annotated; Title 15, Section 555].
