Santa Fe Judge Will Hear First NM Same Sex Divorce Case E-mail

It's possible that the first ever same-sex divorce in New Mexico will be a precedent to resolving the legal issues that may result from marriage licenses obtained back in 2004.

The marriage licenses were obtained through a rogue action by a Sandoval County clerk who issued the said licenses to same sex couples until 4:30 PM of February 20, 2004. By then, the county clerk had been convinced to stop issuing the marriage license, but over 66 same sex couples had already obtained the licenses.

The same-sex couple involved in the first ever divorce in New Mexico are Angela Maria Carrejo, 53, and Karla JaNelle Haught, 43. Carrejo had petitioned for the dissolution of their marriage and for the division of community property.

However, Haught maintained that since the marriage was never really legally valid, then the laws governing community property should not be applied to their divorce case.

The case will raise legal issues which have previously not been argued in the divorce courts of New Mexico.

Carrejo's list of community property included three dogs, pieces of art, furniture, beddings, camping gear and more.

Both Carrejo and Haught had accused each other of domestic abuse during the process of seeking divorce.
