Under a new draft legislation, it may soon become easier for spouses from different European Union countries to get a divorce.
The proposed law enables a couple to choose which country's divorce laws apply to their divorce. Say for example that an Austrian and French couple married and lived in Italy. Under the proposed law, they could ask the Italian court to apply either Austria or France's divorce laws on their situation. Should the couple disagree about which jurisdiction they want to choose, the court will decide which one applies to their case.
The European Commission says that there are around 300,000 international marriage between people from different parts of the EU. The new rules to unify divorce laws were requested by Bulgaria, Greece, Austria, France, Italy, Hungary, Romania, Luxembourg, Slovenia and Spain.
"Thousands of couples find themselves in difficult personal situations because national legal systems have so far failed to provide clear answers," EU Justice Commissioner Viviane Reding said in an interview.
